Terms and Conditions:

Offers:

  • Verbal offers are non-binding.

  • Written offers will be given to the client once Language Factory has reviewed the relevant text.

  • Offers exclude any eventual extra expenses that may occur.

  • The final price can differ from the offer by up to a maximum of 15% (excluding extra expenses incurred and VAT).

  • The rate takes the complexity of the text to be translated/ proof-read/ written into consideration.

  • Work carried out at short notice (within 48, respectively 24 hours, dependant on the length and complexity of the text) is subject to a supplement of +25-100% (minimum 50 CHF), dependant on the length of the text and the agreed delivery time and date.

  • Offers issued are to be used as a recommended price (valid for 30 days after date of issue).

  • The final price is determined according to the total of lines translated into the target language.

  • Language Factory, Fiona Anderegg-Grime, will where possible carry out the work.  In the event that this may not be possible for whatever reason, further contacts will be advised where possible.

  • Language Factory will carry out all work given based on the current valid price list as seen on the website.

  • New clients may be asked to pay a deposit before work is carried out.  All rates exclude VAT.  The currently valid price list is an integral part of these general terms and conditions.

Payment Conditions:

  • Bills for translation work and teaching (groups only) are to be paid within 30 days after the work is delivered/ carried out.

  • A deposit may be requested for group teaching.

  • Individual tuition is to be paid either in advance or on the spot.

Delivery:

  • If no clear deadline is given, Language Factory will carry out the work as quickly as possible.

  • Delivery deadlines must be clearly agreed by the client and Language Factory.

  • Work carried out based on the standard rates will be, depending on the length of the text, delivered after 3 working days, at the earliest.  Otherwise an express supplement should be taken into account.

  • Language Factory cannot accept any responsibility for delays caused by for example problems with the post, telecom or Internet providers.

General Terms and Conditions:

  • The final price is based on the number of lines and keystrokes in the target language.

  • The standard line contains 55 keystrokes (including numbers and empty strokes).

  • Numbers and text in table form will be converted into standard lines.

  • Lines containing under 30 keystrokes will be converted into standard lines.

  • Terminology lists will be calculated according to the time required to compile them.

  • Manuscripts must be clearly legible.  Texts that are not may be subject to a supplement.

  • The classification of the rates to be applied is made by Language Factory, once the text has been assessed.

  • Usual costs (normal telephone, e-mail, fax and postage costs, etc.) are included in the basic price.

  • Expenses (apart from normal postage, fax and e-mail) will be charged to the client.

  • Delivery costs (express postage/ courier costs, etc.) plus extra costs for discs, telephone, modem, fax, post and e-mail costs may be calculated as expenses.

  • Any research required for the work undertaken will be undertaken in a conscientious manner and may be billed as an extra expense, depending on the amount of research required by the text.

  • Due to the complexity of the creative process and  the complexity of copyright legislation, the recommended prices may not be applicable for work on texts which may be published in any form (titles, slogans, advertising texts, etc.).

  • In the event that work that has been agreed upon by both parties and the price offer accepted by the client is for any reason not delivered to Language Factory on the date agreed, or cancelled at the last moment, Language Factory reserves the right to bill the client for the time reserved for the work.  Should Language Factory be advised of a change of date or cancellation more than 48 hours before the date agreed with the client, then this extra charge will not be applied.

Other:

  • Professional discretion and secrecy is guaranteed.

  • Texts to be printed should be, where possible, read through by the client (at least numbers and figures).

  • Responsibility for checking addresses, telephone numbers, etc. must be accepted by the clients for products going to print.

Queries:

  • Queries about translations carried out must be made within 30 Days after receipt of the translated text – the text will otherwise be taken as accepted by the client.

  • Should the queries be well-founded, Language Factory will of course revise the initial translation or, if applicable, let the translation be reworked/ translated again by a third party.

  • Once this has taken place, further claims by the client will not be accepted.

Place of Jurisdiction:

  • Place of jurisdiction is Horgen.
